Renting in Silicon Valley: what to know

California has some of the most renter-protective rules in the country. Here's the short version, plus what to have ready before you apply.

  • security deposits

    Usually one month's rent

Since July 1, 2024 (AB 12), most landlords can collect no more than one month's rent as a deposit. Small landlords with no more than two rental properties and four units can collect up to two months.

  • rent increases

    Capped for covered homes

Under the Tenant Protection Act (AB 1482), covered rentals can rise by 5% plus inflation, up to 10% in any 12 months. Some single-family homes and condos are exempt with the required notice, and some cities add their own rules.

  • screening fees

    Limited by state law

California caps tenant screening fees and adjusts the cap each year. Ask the listing agent what the fee covers before you pay it.

  • fair housing

    Same criteria for everyone

Landlords must apply the same written criteria to every applicant. In California, source of income, including housing vouchers, is protected.

  • apply with confidence

    Have this ready

Photo ID, recent pay stubs or an offer letter, bank statements, references from past landlords, and your credit report if you have one handy.

  • rent now, buy later

    Run the numbers

know the rules

California rental rules every landlord should know

Security deposits

Since July 1, 2024 (AB 12), most landlords can collect no more than one month's rent as a security deposit. Small landlords, meaning individuals or family LLCs with no more than two rental properties and four units, can collect up to two months.

Rent caps and just cause

The Tenant Protection Act (AB 1482) caps yearly increases at 5% plus inflation, with a 10% maximum, and requires a just cause to end a tenancy after 12 months, for many rentals. Single-family homes and condos owned by individuals can be exempt, but only if the lease includes the required written notice.

Local rules on top

San Jose, Mountain View, East Palo Alto and San Francisco add their own rent or eviction rules for some properties. We'll flag what applies to your address before you list.

Fair housing

Screening has to be consistent and lawful. In California, you can't turn down an applicant because they pay with a housing voucher or other lawful source of income.

General information, not legal advice. Rules change, so check with a landlord-tenant attorney about your situation.
